1. Acceptance of Terms
By accessing or using the IRFAN TECH SOLUTIONS platform, website, and services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
2. Definitions
- "Client" refers to any user who posts projects or hires developers through the Platform.
- "Developer" refers to any user who provides services, bids on projects, or completes work through the Platform.
- "Project" refers to a task, job, or service requested by a Client through the Platform.
- "Escrow" refers to the secure holding of funds by IRFAN TECH SOLUTIONS until project completion and approval.
- "Platform" refers to the IRFAN TECH SOLUTIONS website, mobile application, and all associated services.
3. User Accounts
To use our Platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and accept all risks of unauthorized access
- Notify us immediately of any security breach or unauthorized use of your account
- Be solely responsible for all activities that occur under your account
You must be at least 18 years old to register and use our Platform.
4. Services for Clients
Clients using the Platform agree to:
- Provide clear, accurate, and complete project descriptions
- Deposit the full project budget into escrow before work begins
- Review and respond to developer proposals in a timely manner
- Communicate professionally with developers
- Review delivered work promptly and either approve or request revisions
- Release payment upon satisfactory completion of work
Client Protection: Your funds are held in escrow and only released when you approve the completed work. You are protected against fraud and unsatisfactory deliverables.
5. Services for Developers
Developers using the Platform agree to:
- Complete projects as described in your proposal and within the agreed timeline
- Communicate regularly with clients about project progress
- Deliver high-quality work that meets the client's requirements
- Respond to client inquiries and revision requests promptly
- Not outsource projects without client consent
- Maintain professional conduct at all times
Payment Guarantee: Your payment is secured through escrow. Once the client approves your work, funds are released to your wallet within 24 hours.
6. Escrow and Payments
All payments between Clients and Developers are processed through our secure escrow system:
- Clients must deposit the full project amount into escrow before work begins
- Funds remain in escrow until the client approves the completed work
- Upon approval, funds are released to the developer minus applicable commissions
- In case of disputes, funds remain in escrow until resolution
- Refunds are processed according to our dispute resolution policy
Important: Never make payments outside the Platform. Transactions outside the escrow system are not protected and violate our Terms.
7. Commissions and Fees
IRFAN TECH SOLUTIONS charges the following fees:
- Platform Commission: 10% of the total project budget, deducted from the developer's payment upon project completion
- Registration Fee: Free for both Clients and Developers
- Withdrawal Fee: As specified on the withdrawal page (varies by payment method)
- Dispute Resolution Fee: May apply in certain cases (subject to review)
All fees are clearly displayed before transactions. We reserve the right to modify fees with reasonable notice.
8. Dispute Resolution
In case of disagreement between Client and Developer:
- Communication: Both parties should first attempt to resolve the issue through our messaging system.
- Dispute Filing: Either party may file a formal dispute through the Platform.
- Review Process: Our support team will review all communications, deliverables, and evidence.
- Decision: We will make a fair determination based on project requirements and deliverables.
- Resolution: Funds will be either released to the developer or refunded to the client.
Our dispute resolution decisions are final and binding. We aim to resolve all disputes within 5-7 business days.
9. Intellectual Property
For Projects: Upon full payment, all intellectual property rights for the delivered work transfer from the Developer to the Client, unless otherwise agreed in writing.
For Platform: All content, logos, designs, and code on the IRFAN TECH SOLUTIONS Platform are our intellectual property and may not be copied or used without permission.
Developers warrant that they have the right to transfer ownership of the work and that the work does not infringe on any third-party rights.
10. Prohibited Conduct
The following activities are strictly prohibited on our Platform:
- Posting fraudulent, illegal, or misleading projects
- Attempting to make payments outside the Platform
- Harassing, threatening, or abusing other users
- Plagiarizing or submitting others' work as your own
- Creating multiple accounts to manipulate ratings or bids
- Sharing account credentials or selling accounts
- Using the Platform for any illegal activities
Violation of these rules may result in immediate account suspension or termination.
11. Account Suspension/Termination
IRFAN TECH SOLUTIONS reserves the right to suspend or terminate any account that:
- Violates these Terms and Conditions
- Engages in fraudulent or deceptive practices
- Receives multiple negative ratings or complaints
- Fails to complete projects or make payments
- Remains inactive for extended periods
Upon termination, any funds in escrow will be handled according to our dispute resolution process.
12. Limitation of Liability
IRFAN TECH SOLUTIONS acts as an intermediary platform connecting Clients and Developers. We are not responsible for:
- The quality or timeliness of work delivered by Developers
- The accuracy of project descriptions posted by Clients
- Any direct, indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
Our total liability is limited to the amount of fees paid to us in the 6 months preceding any claim.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Lahore, Pakistan.
14. Changes to Terms
We may update these Terms periodically. We will notify users of material changes via:
- Email notification to registered users
- Notice on our website homepage
- Platform notification system
Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
